  Synopsis

  In a rather haphazard way a certain amount of progress has been made. Since early 2007, after nearly a decade of regulatory wrangling, commercially viable prices for several wholesale services have been set by the ACCC. The new OPEL company won the bid for a new regional telecoms network. The metropolitan fibre network is now under review also and this will need to be based on open network principles. Telstra is fighting tooth and nail to try and keep as much of its monopoly in place as possible, but it appears to be fighting a losing battle. Eventually structural reforms are inevitable – they will either be implemented voluntarily by Telstra or forced upon it by regulation. Competition has delivered $900 million of benefits in 2007 according to the government. In early 2008 the industry laid down 17 recommendations for the national Broadband Network. By 2009 the discussions had moved to the NBN environment.

  Synopsis

  The financial crisis has focused global attention on new infrastructure developments. Australia had already begun this process and it is now finding itself at the forefront of investigations into the development of the new infrastructure necessary to help stimulate the economy. Open access infrastructure provides the best way forward as it creates a multiplier effect that will assist developments in healthcare, education, energy and the environment, as well as in Internet and digital media. The Australian industry has embarked on a trans-sectoral campaign, convincing other sectors that an open network will give them the tools to save money and improve their service. At the same time this multiplier effect will create new jobs, perhaps as many as 10,000.

• Australia - Infrastructure - ULL

  The unbundling of the local loop or in more technical terms Unconditioned Local Loop Services (ULLS) involves the use of unconditioned cable (typically copper) between end-users and a telephone exchange, where the cable terminates. This service enables access seekers to supply advanced, high-speed data services, such as DSL, to customers as well as local and long-distance voice services in competition with Telstra. As a result, fundamentally new services can be developed which stimulate innovation, competition and new growth. Telstra has been hampering progress since 1998 it was not until the ACCC received new powers under a new Act that some progress was made in 2003; new tariffs were announced in December 2004. Finally, 2007 we started to see good new wholesale products (i.e. prices), forced upon Telstra by the ACCC.

• Australia - National Broadband Network - Changing the media model

  Synopsis

  For more than a decade the traditional media have been on notice about the changes they would face in relation to the developments in the digital media market. So far they have failed to take decisive action, partly because they were afraid of cannibalisation and partly because their business models do not cater for swift business action. This has brought about a decline in their revenues, but far more importantly they have failed to seize a share of the new market which is now dominated by newcomers such as Google, YouTube and Facebook. The National Broadband Network is the next stage. Again the media have largely been absent from this debate, but the NBN will create new changes with new options. The traditional media players can take a leadership role, looking at the trans-sector opportunities the NBN has on offer – or they can simply copy their outdated models onto the NBN, perhaps by using the wholesale services of a telco. Initial indications are that they are looking at more of the same rather than moving towards media innovation. The media companies do have strong brands and millions of customers, but how can they utilising this advantage?

• Australia - National Broadband Network - Deployment Strategies

  After the vision comes the actual design and the rollout of the national broadband networks. Australia was the first country to get the national purpose vision right, thanks to government leadership. The USA soon followed and is now showing real leadership as well. The Netherlands and New Zealand also are on the right track. Economic and trans-sector innovations are now key items on the political agenda of these countries. There is no silver bullet and each unique situation generates its own alternatives, which in turn inform others involved in similar national projects. The vision gives rise to the creation of social and economic strategies that need to be taken into account in the design and architecture of the infrastructure. Pragmatic solutions need to be developed to maximise the use of existing infrastructure and other resources. Un(der)served areas need to receive priority and local communities and councils can play a key role in this. Wireless broadband can play a major role as well. These early projects could also be an ideal testing ground for trans-sector applications. This report covers these areas on a high strategic level.

  The NBN being a political project there will obviously be political activity involved in the process. However, there is an extremely business-like approach attached to the project. Nevertheless elections, pork-barrelling and new ministers and governments will no doubt have an influence on the NBN. Some of this will be positive, as a trans-sector approach will require the government to commit other government sectors to participate in the project. While thorough preparation will be necessary for a full national launch two large-scale projects were singled out to form a tangible start to the rollout. Tasmania became the first state where the rollout was commenced. The start of the a new regional backbone network and the building of five test sites on the mainland started in early 2010..

  The fact that more than 1,000 people applied to participate in the government’s recent Broadband Forum Realising Our Broadband Future which was planned for 250 people, showed the enormous interest there is in Australia in the trans-sector concept behind the NBN. Unfortunately ultimately only 400 people could be accommodated, including representatives from senior government, community and business, who spent two full days discussing the key trans-sector issues.

• Australia - National Broadband Network - Industry at crossroads

  Australia will be the first country in the world in which the industry will adopt a new plan for the future. In the past this was based on ad hoc decisions and there was little room for long-term planning. The market survived on the crumbs that fell from the Telstra table, and on regulatory relief which often took many years to arrive and was often too late to help a starving competitive environment. Uncertainty was a major obstacle. All decisions depended on Telstra and there was little hope for individual initiatives. Those who developed their own independent plans quickly discovered that Telstra’s reach was long and deep. Good examples of this are TransAct in Canberra and the Unwired service. Even larger companies like Optus and AAPT (Telecom New Zealand) struggled to set their own course. The single most important element of the National Broadband Network (NBN) is that it will provide certainty about future direction. There will be problems, and the outcome will not be perfect, but for the first time individual companies are far more in charge of their own destiny.

  The most critical element to the success of the Australian National Broadband Network will be the infrastructure company that will run the network, NBN Co. They will have to make the critical architecture and design decision for this open wholesale-only company which will form the basis of this new infrastructure for at least the next 25 years.   The decision from the government to launch a $43 billion national FttH broadband network is a clear indication that they believe broadband is essential infrastructure. It fulfils a national purpose as its trans-sector multiplier effect delivers massive social and economic benefits in healthcare, education, energy and the environment. A digital economy requires an open broadband infrastructure, and for that to work it can only be built by a utility (NBN Co). While there certainly are questions regarding the business model and the investment plan, there is widespread support for the visionary plan.   Synopsis

  Soon after the government announced the National Broadband Network (NBN) in April 2009, Telstra finally understood that changes were now inevitable and they reacted swiftly. A new management team was appointed led by the new CEO, David Thodey. Telstra immediately announced its support for the NBN and its willingness to work together with the government. The company also put its weight behind the trans-sector concept which will be the avenue to generating new revenue. Negotiations were launched with the government investigating how Telstra could best participate, including taking a shareholding in NBN Co. A first agreement was reached at the end of 2009.

• Australia - National Broadband Network Trans-sector projects

  After the National Broadband Network (NBN) announcement in 2009 the government commenced the right policy initiatives that would confirm its trans-sector approach towards the NBN. In order to build a sound business model for the NBN other sectors need to participate. The government indicated that the NBN is a nation building project - it will become a social highway – and there is a clear national purpose for it. • Australia - Pay TV - Regulatory - Access Overview, Analysis and Disputes

  A very important change under the Telecommunications Act 1996, was the declaration, or deeming, of broadband cable networks. Until the Act came into force the cable operators could refuse channel operators access to their networks, thus giving them yet another way to monopolise the market. As a declared service the Australian Competition and Consumer Commission (ACCC) can arbitrate in situations whereby commercial arrangement between the cable operator and the channel provider cannot be made. Despite all this, so far no independent organisations have been able to gain access to the pay TV networks. Please note that is this report is updated infrequently.
